1. END USER LICENSING AGREEMENT
This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and DDK POSITIONING LTD. for the DDK Nav software product identified above which may include associated software components, and "online" or electronic documentation ("SOFTWARE PRODUCT"). By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. This license agreement represents the entire agreement concerning the program between you and DDK POSITIONING LTD., (referred to as " DDK POSITIONING"), and it supersedes any prior proposal, representation, or understanding between the parties. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE PRODUCT. The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.
By subscribing to the DDK POSITIONING correction and (DDK Nav product) provision services (the "Service"), you agree to these Terms of Use. If you do not agree to these Terms of Use, you may not subscribe to the DDK POSITIONING GNSS correction services.
Through the Service, you have access to a variety of resources, information, content, services as well as outputs or results from those services, collectively referred to as "Information".
DDK POSITIONING will notify you when any changes are made to the Terms and Conditions; in addition to this the most current Terms of Use are at ddknav.com.
2. RESERVATION OF RIGHTS
2.1. The Service and Information provided through the Service are the intellectual property and copyrighted works of DDK POSITIONING or a third party provider. All rights, title and interest not expressly granted with respect to the Service and Information provided through the Service are reserved. All Information is provided on an "As Is" and "As Available" basis, and DDK POSITIONING reserves the right to terminate the permissions granted to you and your use of the Information at any time.
3. PRIVACY AND CONTACT INFORMATION
3.1. DDK POSITIONING informs you that your information is automatically stored in our subscribers’ database. The information supplied by you may be used by DDK POSITIONING for research and marketing purposes and for the provision of the Information. 4. QUALITY OF SERVICE
4.1. While DDK POSITIONING will make reasonable efforts to procure that the Information, in particular the GNSS correction and product provision services are always available and perform as defined, interruptions in the Service and degradation of its performance may occur from time to time and therefore the availability and quality of the data service is not guaranteed. Therefore, DDK POSITIONING accepts no responsibility for the availability or quality of the Service under any circumstances.
5. USER NAME, PASSWORDS AND MEANS OF ACCESSING THE SERVICE AND INFORMATION
5.1. The use of the Service without a current, valid, fully paid subscription is prohibited.
5.2. You agree not to access or use the Service in any manner that could damage, disable, overburden, or impair any DDK POSITIONING accounts, computer systems or networks. You agree not to attempt to gain unauthorized access to the Service or any DDK POSITIONING accounts, computer systems or networks. You agree not to interfere or attempt to interfere with the proper working of the Service or any DDK POSITIONING accounts, computer systems or networks.
5.3. For subscribing the Service, you must complete the registration process by providing us with current, complete and accurate information as required by the applicable registration form. You may also be required to choose a password and a user name. You agree not to share your user(s) and password(s), account information, or access to the Service with any other person. You are responsible for maintaining the confidentiality of password(s) and account information, and you are responsible for all activities that occur through the use of your password(s) or account(s) or as a result of your access to the Service. You agree to notify DDK POSITIONING immediately of any use of your password(s) or account(s) that you did not authorize or that is not authorized by these Terms of Use.
5.4. You are not authorized to sell, rent, lease, share, copy, rebroadcast, transfer or sublicense your Service subscription or the Information provided through this Service to any third party without the express written permission of DDK POSITIONING. DDK POSITIONING reserves the right to cancel the access to the Service without any compensation or payment refunding if you do not comply with these obligations.
5.5. There is no guarantee that any e-mail you send will be received by DDK POSITIONING. E-mail is not a secure form of communication and can be intercepted by third parties so e-mails sent to DDK POSITIONING when making use or accessing Information and Service are not confidential or may be subject to tampering. Any information sent by e-mail is done so at your own risk and you should carefully consider its sensitivity before transmitting it.
6. RIGHT TO USE
6.1. Subject to these Terms of Use you are authorized to personally use the Service and the Information provided through the Service, for the purpose of using the DDK POSITIONING products and corrections for GNSS Positioning.
6.2. You are authorized to include the Service results in any publication provided you also include an explicit and clear reference to DDK POSITIONING and to our correction and product provision services and the site ddknav.com.
